Sponsor: Drive Now LLC 4606 Eastern Ave. Baltimore MD 21224 (“Sponsor”).

Term: The Driver Education Love Special (“Love Special”) begins on January 31st, 2009, at 9:00 a.m. Eastern Standard Time (EST), and ends on February 28, 2009 at 5 p.m., EST (“Term”).

Eligibility: Love Special is open to all legal U.S. residents, including the District of Columbia, who are above the age of majority in the state in which they reside at the time of entry and who had Internet access prior to December 31, 2008. Void in Puerto Rico, and where prohibited. Employees of Drive Now, LLC, its affiliated companies and members of the immediate families of each are not eligible. Love Special is subject to all local, state and federal laws and regulations. By entering this Love Special, all entrants agree to comply with and be bound by these Official Rules, and to comply with all federal, state and local laws and regulations.

How to Enter: No purchase necessary to enter or win the Love Special. You must have Internet access as of December 31, 2008 order to enter.

Mail-in Entry.  Print your name, mailing address (no P.O. Boxes) and phone number on a 3x5 postcard and mail to:  Drive Now LLC

Limit one entry per Love Special period, per household up to three (3) entries. All entries and requests become the Sponsor’s property and will not be returned or acknowledged. Illegible entries and entries with P.O. boxes are void. The Sponsor is not responsible for lost, late, damaged, incomplete, misdirected, mutilated, postage due, or entries not received in time for drawing. All entries must be post marked no later than February 28, 2009 and received no later than March 3, 2009.

Prizes: Sponsor will award The opportunity to receive the Maryland State Driver Education Certificate Program for Free.  Approximate retail value of complete prize package: $459.98. No more than the stated number of prizes will be awarded.

Winner Selection: Potential winner(s) will be selected in a random drawing each week, from among all eligible entries received throughout the Term. The drawing will be conducted by Sponsor. Potential winners will be contacted by e-mail and by phone to the e-mail address and phone number provided on the registration page. If, after reasonable attempts to determine or contact the winner, the potential winner does not respond within seven (7) calendar days of such notification, the entire prize will be forfeited and Sponsor will award the applicable prize to an alternate winner by random drawing from among all remaining eligible entries.  Prizes will be fulfilled within 12 months after the conclusion of the Promotion.  All decisions of Sponsor are final. Odds of winning each prize are dependent upon number of eligible entries received.

Prize Restrictions: Limit one (1) prize per individual/household. Prizes are non-transferable, and no substitutions are allowed except by Sponsor, who reserves the right to award a prize of equal or greater value, should the prize become unavailable for any reason. Taxes and any costs associated with the receipt of the prize are the responsibility of the winner. By accepting any prize, winners consent to use of his/her name or likeness for advertising/publicity purposes without further consideration, except where prohibited by law.

Privacy: Any information collected will be subject to Sponsor’s Privacy Policy. By entering the Love Special, you acknowledge that you have agreed to the Policy and you consent to the collection, use and disclosure of your personal information for the purposes of administering this Love Special in accordance with the Policy. Conduct: By participating, entrants agree to comply with and be bound by these Official Rules. Failure to comply with these Official Rules may result in disqualification from the Love Special. Entrants further agree to comply with and be bound by decisions of Sponsor, which shall be final and binding in all respects. Sponsor reserves the right at its sole discretion to disqualify any individual it finds to be: (a) tampering or attempting to tamper with the entry process or the operation of the Love Special or any Sponsor web site; (b) violating these Official Rules; (c) violating the Official Rules of service, conditions of use and/or general rules or guidelines of any Sponsor property or service; or (d) acting in an unsportsmanlike or disruptive manner, or with intent to annoy, abuse, threaten or harass any other person.

Release and Limitation of Liability. By entering, participants release and hold harmless Sponsor, respective parent, subsidiaries, affiliates, directors, officers, employees and related entities (collectively, “Releasees”) from any and all liability, claims or actions of any kind whatsoever for injuries, damages or losses to persons and property that may be sustained in connection with the receipt, ownership, or use of the prize from or arising out of participation in this Love Special. Sponsor assumes no responsibility or liability for (1) any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of, entries; (2) any incorrect or inaccurate information, whether caused by entrants, printing errors or by any of the equipment or programming associated with or utilized in the Love Special; (3) any problems or technical malfunction of any telephone network or telephone lines, computer on-line systems, servers, or providers, computer equipment, software, failure of any e-mail or entry to be received by Sponsor on account of technical problems, human error or traffic congestion on the Internet or at any Web site, or any combination thereof, including any injury or damage to participant’s or any other person’s computer relating to or resulting from participation in this Love Special or downloading any materials in this Love Special; (4) technical or human error which may occur in the processing of entries; or (5) any injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from entrant’s participation in the Love Special or receipt or use or misuse of any prize.

Internet: If for any reason this Love Special is not capable of running as planned due to infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of the Sponsor which corrupt or affect the administration, security, fairness, integrity or proper conduct of this Love Special, the Sponsor reserves the right at its sole discretion to disqualify any individual who tampers with the entry process, and/or to cancel, terminate, modify or suspend the Love Special.

CAUTION: ANY ATTEMPT TO DELIBERATELY DAMAGE ANY WEB SITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE LOVE SPECIAL IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, THE SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES OR OTHER REMEDIES FROM ANY SUCH PERSON(S) RESPONSIBLE FOR THE ATTEMPT TO THE FULLEST EXTENT PERMITTED BY LAW.

Entry can only be made via one (1) e-mail address per person. In the event of a dispute as to the identity of a winner based on an e-mail address, the winning entry will be declared made by the authorized account holder of the e-mail address submitted at time of entry. “Authorized account holder” is defined as the natural person who is assigned to an e-mail address by an Internet access provider, online service provider or other organization (e.g., business, educational, institution, etc.) that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address.

Force Majeure: The failure of the Releasees to comply with any provision of these Official Rules due to an act of God, hurricane, war, fire, riot, earthquake, act of public enemies, actions of governmental authorities outside of the control of the Releasees (excepting compliance with applicable codes and regulations) or other force majeure event will not be considered a breach of these Official Rules.

Disputes: Except where prohibited or otherwise outlined in these Official Rules, entrant agrees that: (1) any and all disputes, claims and causes of action arising out of or connected with this Love Special or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by the appropriate Maryland State Court; (2) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Love Special, but in no event attorneys’ fees; and (3) under no circumstances will entrant be permitted to obtain awards for, and entrant hereby waives all rights to claim, indirect, punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of the entrant and Sponsor in connection with the Love Special, shall be governed by, and construed in accordance with, the laws of the State of Maryland, without giving effect to any choice of law or conflict of law rules (whether of the state of Maryland or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of Maryland.
